Welcome to VividMe. By accessing or using the VividMe application and its services, you agree to be bound by these Terms of Service. Please read them carefully.
If you do not agree to these Terms, please do not use VividMe. Your continued use of VividMe after any changes to these Terms constitutes your acceptance of the updated Terms.
1. Eligibility
To use VividMe, you must:

- check_circle Have the legal capacity to enter into a binding agreement
- check_circle Not be prohibited from using the service under applicable law
2. User Accounts
When you create an account with VividMe, you agree to:

- check_circle Keep your account credentials secure and confidential
- check_circle Notify us immediately of any unauthorized use of your account
- check_circle Be responsible for all activity that occurs under your account
You may not share, sell, or transfer your account to any other person. Each account is for a single user only.
3. Permitted Use
VividMe grants you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial creative purposes. You may:
- check_circle Generate AI images and videos for personal creative projects
- check_circle Download and share your generated content on personal social media
- check_circle Use AI-generated outputs for non-commercial creative expression
4. Prohibited Conduct
You agree not to use VividMe to:
Harmful or Illegal Content
Generate, upload, or distribute content that is illegal, defamatory, obscene, pornographic, threatening, or promotes violence or discrimination.
Intellectual Property Violations
Upload reference images or generate outputs that infringe on the copyright, trademark, or other intellectual property rights of any third party.
Impersonation & Deepfakes
Create realistic synthetic media of real individuals without their explicit consent, particularly for purposes of fraud, harassment, or defamation.
Service Abuse
Attempt to reverse-engineer, scrape, overload, or interfere with the platform's infrastructure, APIs, or AI models. Automated bulk usage without written permission is prohibited.
Circumventing Payments
Attempt to bypass, manipulate, or fraudulently obtain subscriptions, gems, or premium features without proper payment.
Violation of these prohibitions may result in immediate account suspension or termination, at our sole discretion.
5. Intellectual Property

All software, technology, branding, design, and proprietary AI models underlying VividMe are and remain the exclusive intellectual property of VividMe. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology.
personYour Content
You retain ownership of the original reference images you upload. For AI-generated outputs, you are granted a worldwide, royalty-free license to use them for personal, non-commercial purposes. You grant VividMe a limited license to process your inputs solely to provide the service.
AI-generated outputs may not be registered for copyright protection in all jurisdictions. You are solely responsible for ensuring your use of generated content complies with applicable law.
6. Subscriptions & Purchases
All purchases are final. We do not offer refunds except as required by applicable law or Apple's refund policies. Unused gems are forfeited upon account termination.
7. Disclaimers
VividMe is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to:
- remove_circle Uninterrupted or error-free operation of the service
- remove_circle Accuracy, quality, or suitability of AI-generated outputs for any particular purpose
- remove_circle That generated content will be free from third-party intellectual property claims
You use VividMe and its AI-generated outputs entirely at your own risk. VividMe is not liable for any damages arising from your use or inability to use the service.
8. Limitation of Liability
To the maximum extent permitted by applicable law, VividMe and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill.
In no event shall VividMe's total aggregate liability exceed the greater of: (a) the amount you paid to VividMe in the twelve months preceding the claim, or (b) USD $50.
9. Termination
Either party may terminate the agreement at any time:
By You
You may delete your account at any time via Settings → Delete Account. Active subscriptions must be cancelled separately through Apple ID Settings.
By VividMe
We reserve the right to suspend or permanently terminate your account, with or without notice, if you violate these Terms or engage in conduct we deem harmful to other users or the platform.
Upon termination, your license to use VividMe ceases immediately. Sections 5, 7, 8, and 10 survive termination.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable international law. Any disputes arising out of or relating to these Terms or VividMe shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
Nothing in these Terms limits your rights under applicable consumer protection laws in your jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. When material changes are made, we will notify you via an in-app notification, a pop-up alert, or email at least 7 days before the changes take effect.
Continued use of VividMe after the effective date constitutes your acceptance of the revised Terms. If you do not agree, please stop using VividMe and delete your account.
